PAYMENT & CANCELLATION - PERSONAL SESSIONS (LOCATION & STUDIO)
• No images will be taken without 100% payment.
• No cash will be accepted.
• A non-refundable 50% booking fee is required to secure a booking over R 1250.
• Full payment required for session less than R 1250 - and is non refundable.
• Cancellation forfeits booking fee. Balance will be refunded with an additional R 200 refund charge.
• Re-scheduling incurs an additional R350 surcharge.
• If a photographer needs to reschedule a R350 discount will be given on the session.
• No show will forfeit full amount of the session fee - no refund or rescheduling.
• Latecomers will not be allotted additional time on their session - extra time is billed at R550 per 15 minutes.

SPECIAL CIRCUMSTANCES FOR CANCELATION
• Immediate grave illness rescheduling will be accepted penalty free - no refund on booking fee
• If weather influences the ability to be outdoors a penalty free reschedule is allowed on photographers discretion

COPYRIGHT & RELEASE CONDITIONS
I hereby give VISION POINT PHOTOGRAPHY the absolute right and permission to use photographic portraits, pictures, digital images or videotapes of myself, or in which I may be included in whole or part, or reproductions thereof for any lawful purpose whatsoever, including but not limited to print or social media, without payment or any other consideration.

I hereby waive any right that I may have to inspect and/or approve the finished product or the copy that may be used in connection therewith, wherein my likeness appears, or the use to which it may be applied. This excludes the publishing of images of minors.

Should the CLIENT request approval of images before being published on social media or please note so in the information sheet.
 
VISION POINT PHOTOGRAPHY hereby agrees that any images taken are released to the client for personal usage on social media or printing of photographs. Under no circumstances will RAW images be handed over.


EXTRA EDITING & DELIVERY OF IMAGES
The determination of images delivered is left to the discretion of the photographer.

VISION POINT PHOTOGRAPHY will do the best editing for your images in their style of previous works. Editing is limited to color correction. Any additional editing required will be billed @ R850 p/h.
Examples of additional editing include but are not limited to: Any marks in the face / body that requires extensive touch-up; editing out spots or marks on clothing; slimming and tucking; editing out people or adding people in photographs; removing distracting objects; beauty editing of skin.
Images will be delivered via a on-line gallery unless otherwise discussed.

Images will be ready within: 
5 days for events
14 days regular session
20 days newborn session
30 days collaborations
Video will be ready in 30 days.

LOSS OF DIGITAL FILES
In the unlikely event that all digital files have been lost, stolen or destroyed for reasons beyond VISION POINT PHOTOGRAPHY’s control, including but not limited to camera, hard drive, or equipment malfunction, liability is limited to the partial return of payments received for the session, excluding travel and accommodation. The limit of liability for a partial loss of originals shall be a prorated amount of the photographs lost based on the percentage of total number of originals. 

LIMIT OF LIABILITY
• No completed session are refundable.
• If for any reason the CLIENT is not entirely satisfied, please communicate with VISION POINT PHOTOGRAPHY immediately so the issue can be resolved. Re-shoots will be done at the sole discretion of  VISION POINT PHOTOGRAPHY.
• The CLIENT understands and agrees that VISION POINT PHOTOGRAPHY is not responsible for or liable in any way for any damage to or loss of the CLIENT's belongings or for any personal injury to the CLIENT before, during or after the session. The CLIENT shall indemnify, defend and hold harmless VISION POINT PHOTOGRAPHY and its agents and employees from and against all claims, damages, losses and expenses, including but not limited to attorney fees arising out of or resulting from the performance of the work described in this Agreement.

PERFORMANCE & DEATH
In the unlikely event that the assigned photographer from VISION POINT PHOTOGRAPHY is unable to perform to the guidelines of this contract due to an injury, illness, act of God or other cause beyond their control, VISION POINT PHOTOGRAPHY will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received including the booking fee. In case of the death of a photographer or client this agreement is void and is cancelled with immediate effect. Any monies paid will be refunded in full including the booking fee.

 
PHOTO SHOOT SPECIALS
• Terms and Conditions of special will be communicated either via WhatsApp or email.
• Full payment is required for specials and is non refundable.
• Rescheduling can not be done on specials and any monies paid will be forfeited unless weather influences.
• Cancellation forfeits monies paid.
• Monies paid for specials are not transferable to other sessions.
• Latecomers will not be allotted additional time on their session and also limit the amount of images delivered.
• Additional time is billed at R550 per 15 min.
• Selection of images is at the desrcetion of the photographer.
• Additional images can be purchased at R 70 per image to be selected by client.
